1. Acceptance of Terms
Welcome to Factorytechnews (“the Site,” “we,” “us,” or “our”). The following Terms of Service (“Terms”) govern your access to and use of the Factorytechnews.com website and any related services, features, content, or applications offered by us (collectively, the “Services”).
By accessing, browsing, or otherwise using the Site, you acknowledge that you have read, understood, and agree to be bound by these Terms and to comply with all applicable laws and regulations. Factorytechnews is a news aggregation service. We collect, curate, and display headlines, summaries, excerpts, and links to news articles and other content (“Third-Party Content”) from various external sources across the internet. You understand and agree that the Services are provided on an “AS IS” and “AS AVAILABLE” basis. We assume no responsibility for the timeliness, deletion, misdelivery, or failure to store any user communications or personalization settings.
3. Intellectual Property Rights
3.1. Our Content
All content originally created and provided by Factorytechnews on the Site, including but not limited to text, graphics, logos, button icons, images, audio clips, digital downloads, data compilations, software, and the selection, coordination, and arrangement of such materials (collectively, “Our Content”) is the property of Factorytechnews, its licensors, or its content providers and is protected by international copyright, trademark, and other intellectual property laws.
3.2. Third-Party Content and Fair Use
The Site features summaries, excerpts, headlines, and links to news articles and other content owned by third parties (“Third-Party Content”). Factorytechnews does not claim any ownership rights in the original Third-Party Content.
We believe our use of Third-Party Content constitutes a “fair use” under applicable copyright law, including but not limited to Section 107 of the U.S. Copyright Act, as it is used for purposes such as criticism, comment, news reporting, teaching, and research. Factorytechnews respects the intellectual property rights of others and expects its users to do the same. 7.2. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL FACTORYTECHNEWS, ITS OFFICERS, DIRECTORS, EMPLOYEES, OR AGENTS, BE LIABLE TO YOU FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, PUNITIVE, OR CONSEQUENTIAL DAMAGES WHATSOEVER RESULTING FROM ANY (I) ERRORS, MISTAKES, OR INACCURACIES OF CONTENT, (II) PERSONAL INJURY OR PROPERTY DAMAGE, OF ANY NATURE WHATSOEVER, RESULTING FROM YOUR ACCESS TO AND USE OF OUR SERVICES, (III) ANY UNAUTHORIZED ACCESS TO OR USE OF OUR SECURE SERVERS AND/OR ANY AND ALL PERSONAL INFORMATION STORED THEREIN, (IV) ANY INTERRUPTION OR CESSATION OF TRANSMISSION TO OR FROM OUR SERVICES, (V) ANY BUGS, VIRUSES, TROJAN HORSES, OR THE LIKE, WHICH MAY BE TRANSMITTED TO OR THROUGH OUR SERVICES BY ANY THIRD PARTY, AND/OR (VI) ANY ERRORS OR OMISSIONS IN ANY CONTENT OR FOR ANY LOSS OR DAMAGE OF ANY KIND INCURRED AS A RESULT OF YOUR USE OF ANY CONTENT POSTED, TRANSMITTED, OR OTHERWISE MADE AVAILABLE VIA THE SERVICES, WHETHER BASED ON WARRANTY, CONTRACT, TORT, OR ANY OTHER LEGAL THEORY, AND WHETHER OR NOT THE COMPANY IS ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
8. Indemnification
You agree to defend, indemnify, and hold harmless Factorytechnews, its affiliates, and their respective officers, directors, employees, and agents from and against any and all claims, damages, obligations, losses, liabilities, costs, or debt, and expenses (including but not limited to attorney’s fees) arising from: (i) your use of and access to the Site; (ii) your violation of any term of these Terms; (iii) your violation of any third-party right, including without limitation any copyright, property, or privacy right; or (iv) any claim that your User Content caused damage to a third party.
